1 About these terms

These Terms and Conditions (the "Terms") govern:

• Your use of the website birjiwan.co (the "Website"); and

• Any class, private session, course, workshop, or membership you book or access through it (the "Services").

The Website and the Services are operated by Camille Jean, trading as Birjiwan, NIE Y5778663L, with address at Camí de sa Font 7, 07195 Galilea, Illes Balears, Spain, registered as autónoma in the Régimen Especial de Trabajadores Autónomos (RETA), contactable at birjiwan@gmail.com ("we", "us", "our", "Birjiwan").

By using the Website or booking any Service, you accept these Terms. If you do not accept them, please do not use the Website or book a Service.

These Terms are governed by Spanish law and comply with, among others, Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE) and Royal Legislative Decree 1/2007 approving the consolidated text of the General Law for the Defence of Consumers and Users (TRLGDCU).

2 Use of the Website

2.1 General use

Accessing the Website does not, by itself, create a commercial relationship with us. By using the Website, you agree to do so in accordance with these Terms, applicable law, good faith, and public order.

2.2 Prohibited use

You agree not to:

• Use the Website for any unlawful, harmful, or fraudulent purpose;

• Reproduce, distribute, modify, or publicly communicate any part of the Website's content (text, images, audio, video, code, layout) for commercial purposes or without our prior written authorisation;

• Engage in any activity that could damage, disable, overload, or impair the Website;

• Attempt to gain unauthorised access to the Website's systems, servers, or any associated network;

• Use automated tools (bots, crawlers, scrapers) to extract content from the Website, except for legitimate search-engine indexing in line with our robots.txt.

We make reasonable efforts to keep the Website secure, but the security of internet-based systems cannot be fully guaranteed. We do not warrant the absence of viruses or other elements that may cause alterations to your systems.

2.3 Comments and user-submitted content

If the Website allows you to leave comments or other user-submitted content, the following content is not permitted and may be removed at our discretion:

• Content unrelated to the Website's subject matter;

We make reasonable efforts to keep the Website available and functioning, but we do not guarantee uninterrupted availability. We are not liable for damages resulting from temporary unavailability, maintenance, technical issues, or third-party service interruptions.

3 The services

3.1 What we offer

Birjiwan offers online group classes, private sessions, courses, workshops, and memberships in Kundalini yoga, meditation, and related practices. Sessions are delivered remotely via video conferencing (Zoom or similar) and may be live, pre-recorded, or a combination.

The description, duration, level, schedule, price, and access details of each Service are published on the Website at the time of booking.

3.2 Teaching language

All classes and sessions are taught in English. A working understanding of spoken English is required for safe participation, as instructions, contraindications, and safety cues are given in English throughout.

3.3 No medical or therapeutic service

Our Services are educational and wellness-oriented. They are not medical care, psychological treatment, diagnosis, or therapy, and they are not a substitute for professional medical or mentalhealth advice. If you have any health concerns, you must consult a qualified professional.

4 Booking, payment, withdrawal, and cancellations

4.1 Booking and payment

Bookings are made through the Website using the available payment methods. The contract is formed when your booking is confirmed and payment is received. Prices are shown in euros and include applicable taxes where relevant. You will receive a confirmation email with access details.

4.2 Right of withdrawal (statutory)

In accordance with the TRLGDCU, you have the right to withdraw from this contract within 14 calendar days of booking, without giving any reason. To exercise this right, send an unequivocal statement (e.g. email to birjiwan@gmail.com) before the 14-day period expires. We will refund all eligible payments within 14 days of receiving your withdrawal request.

Express consent to immediate performance. If you book a Service scheduled to take place during the 14-day withdrawal period, you expressly consent to the performance of the Service beginning before the period ends and acknowledge that:

• Once the Service is fully performed, you lose the right of withdrawal for that Service;

• If the Service is partially performed, we may retain a proportionate amount.

4.3 No-refund policy

Beyond the statutory right of withdrawal in section 4.2, all bookings, individual sessions, class packs, courses, workshops, and memberships are non-refundable. By booking, you accept that payments are final and will not be reimbursed except where required by Spanish consumer law or where we are unable to deliver the Service.

4.4 Cancellations by you

Group classes: [insert your policy — suggested default: cancellations made more than 12 hours before the class entitle you to one transferable credit valid for 30 days; less than 12 hours, no credit; no-shows count as attended.]

Private sessions: [insert your policy — suggested default: cancellations made more than 48 hours before the session may be rescheduled once at no cost; less than 48 hours, the session is forfeited and no rescheduling is offered.]

Class packs and credits: [insert your policy — suggested default: valid 6 months from purchase, non-transferable, non-refundable.]Memberships: [insert your policy — suggested default: billed monthly in advance; you may cancel at any time with effect from the next billing cycle; no partial refunds for the current cycle.]

4.5 Cancellation by us

If we cancel or reschedule a Service, you will be offered either a credit toward another Service or a full refund of the amount paid for the cancelled Service.

4.6 Missed classes

If you do not attend a booked Service without cancelling in line with section 4.4, the Service is considered delivered and no refund or credit applies.

5 Health, safety, and your responsibility

Yoga, breathing exercises (pranayama, including breath of fire / kapalabhati / bhastrika), Kundalini kriyas, and meditation can have powerful effects on the body and mind. Most participants experience these benefits safely, but the practice is not appropriate for everyone, and it carries certain risks you must be aware of before participating.

5.1 Health declaration

By booking a Service, you declare that:

• You have considered your physical and mental health and are not aware of any condition that contraindicates participation;

• You have consulted, or will consult, a qualified medical professional if you have any doubts about your suitability for the practice;

• You will inform us in advance of any relevant health condition (physical or mental);

• You take full responsibility for the decision to participate.

5.2 Conditions that may require medical clearance

You should consult a qualified medical professional before practising if any of the following apply:

• Pregnancy (any stage), the first trimester postpartum, or fertility treatment;

• Menstruation (some practices, particularly those involving navel pumping, breath retention, or inversions, are traditionally avoided);

• Cardiovascular conditions (high or unstable blood pressure, heart disease, recent cardiac events);

• Respiratory conditions (asthma, COPD, recent infection);

• Epilepsy or a history of seizures;

• Glaucoma, retinal detachment, or other serious eye conditions;

• Recent surgery or any acute injury;

• Severe musculoskeletal conditions, herniated discs, post-surgical recovery;

• Pacemaker, defibrillator, or other implanted medical device;

• Diabetes (particularly insulin-dependent);

• Eating disorders, current or recent.

5.3 Mental health and Kundalini-specific considerations

Kundalini yoga, intensive pranayama, and prolonged or intensive meditation can produce strong psychological and emotional effects. While most people experience these as positive, in some cases they may include or trigger:

• Heightened anxiety, panic, or restlessness;

• Emotional release (crying, anger, grief);

• Dissociation or feelings of unreality;

• Disrupted sleep or unusual energetic sensations;

• Resurfacing of past traumatic memories;

• In rare cases, more serious destabilisation in individuals with predisposing factors.

You should consult a qualified mental health professional before participating if you have, or have had, any of the following:

• A diagnosed psychiatric condition (including but not limited to psychosis, bipolar disorder, severe depression, severe anxiety disorders, PTSD or complex trauma, dissociative disorders);

• Current use of psychotropic medication where the prescribing professional has not been informed of your intention to practise;

• Recent psychological crisis or hospitalisation;

• A history of adverse reactions to meditation, breathwork, or similar practices;

• Active substance dependency.

If you are uncertain whether the practice is suitable for you, please contact us before booking.

5.4 Your responsibility during practice

Throughout every session:

• Practise within your own limits. The golden rule: if it does not feel right, do not do it.

• Stop immediately if you feel pain, dizziness, shortness of breath, palpitations, nausea, or significant emotional distress.

• Modify or skip any posture, breath, or kriya that does not suit your body or state on the day.

• Ask for adjustments or alternatives at any point.

• If you are pregnant, menstruating, or recovering from injury or surgery, replace contraindicated practices with long, deep breathing or rest.

You retain full responsibility for monitoring your own physical and emotional state and for adapting the practice to your own circumstances.

5.5 Online practice — your environment

Because Services are delivered online, you are solely responsible for ensuring a safe practice environment, including:

• A clear practice space free of furniture, sharp edges, or hazards;

• A non-slip surface or yoga mat;

• Adequate ventilation, lighting, and temperature;

• A stable internet connection and functioning equipment;

• Privacy and absence of disturbances during practice;

• Access to water and any medication or medical device you may need.We cannot see your full environment, your full body, or assess your state during the class. You acknowledge this limitation and accept responsibility for self-monitoring and for stopping or adapting the practice as needed.

5.6 Emergencies

In the event of a medical or psychological emergency during a session, you must contact local emergency services immediately (in Spain: 112). We will offer reasonable support but cannot substitute for emergency medical care. If during a session we observe signs that may indicate an emergency, we may interrupt the session and recommend you seek immediate help.

6 Intellectual property and content rules

6.1 Ownership of content

All content created and delivered by Birjiwan — including but not limited to live and recorded classes, sequences and kriyas as taught, guided meditations, written materials, manuals, audio and video recordings, course structures, course names, methodology, branding, photography, marketing copy, blog posts, newsletters, and any membership content — is the exclusive intellectual property of Camille Jean / Birjiwan and is protected under Spanish and international copyright and intellectual property law (in particular Royal Legislative Decree 1/1996 approving the consolidated text of the Intellectual Property Law).

The traditional teachings of Kundalini yoga are part of a shared lineage; what is protected here is the specific selection, sequencing, expression, and presentation of those teachings as delivered by Birjiwan, together with all original material.

6.2 Recording by us

Some Services may be recorded for use as replays, course material, or promotional content. Where a Service will be recorded, this will be communicated in advance, and you may choose to keep your camera off and microphone muted during recorded portions. Any use of your image or voice in promotional material requires separate explicit consent.

6.3 Recording by you — prohibited

You may not record (audio or video), photograph, screenshot, livestream, or otherwise reproduce any Service or associated material without our prior written consent.

6.4 Use of materials provided to you

Any material provided to you (manuals, recordings, mantras, sequences, membership content, etc.) is licensed for personal, non-commercial use only. You may not:

• Share, distribute, resell, sublicense, or publish the material;

• Use the material to teach others, whether for free or for payment;

• Reproduce the material in your own classes, courses, books, recordings, or content;

• Translate, adapt, or create derivative works from the material;

• Remove or alter any attribution, credit, or copyright notice.

6.5 No use for AI training, machine learning, or automated processing

You expressly agree that you will not, and will not permit any third party to, use any content created or delivered by Birjiwan — including class recordings, written materials, audio, video, transcripts, methodology descriptions, or any other output — for the purposes of:

• Training, fine-tuning, evaluating, or otherwise developing any artificial intelligence model, large language model, machine learning system, or generative AI system;

• Inputting, uploading, transmitting, or otherwise feeding the content into any AI tool, service, or platform (whether public or private), including for the purposes of summarising, transcribing, paraphrasing, generating derivative content, or extracting teaching material;

• Automated scraping, crawling, indexing, harvesting, or systematic extraction by any means.

This prohibition applies to all participants, members, and visitors, and survives termination of your participation.

We expressly reserve all rights under Article 4 of Directive (EU) 2019/790 to opt out of text and data mining of our content. Any use of our content in violation of this section constitutes infringement of our intellectual property rights and may result in legal action, including claims for damages.

7 Code of Conduct

You agree to:

• Treat the teacher and other participants with respect;

• Not engage in disruptive, harassing, discriminatory, or threatening behaviour;

• Not attend Services under the influence of alcohol or recreational drugs;

• Not share access links, passwords, or login credentials with third parties.

We reserve the right to remove any participant from a Service and to terminate the contract without refund in cases of serious breach.

8 Minors

Our Services are intended for participants aged 18 and over. Participation by anyone under 18 requires prior contact and the express written consent of a parent or legal guardian, and is at our discretion.

Your rights

In addition to managing cookies as described above, you have the rights set out in our Privacy Policy (access, rectification, erasure, restriction, objection, portability, and withdrawal of consent). You also have the right to lodge a complaint with the AEPD: https://www.aepd.es.

Changes to this Policy
